Use of My Account on Secure Path^SM by Transamerica (the "Service") by any end user (the "User") is subject to the following terms and guidelines:

• The Service is proprietary to Transamerica Retirement Management, Inc. ("Transamerica") and the User shall not use the Service except as authorized by Transamerica herein.
• The User is responsible for the confidentiality and use of their password and other security data, methods and devices, as well as the information or data transmitted using such password and other security data, methods and devices.
  
  • User shall immediately notify Transamerica if there is unauthorized use of his or her password and other security data.
  • User shall immediately notify Transamerica if there is a discrepancy in their account information or data.
• Transamerica shall not be under a duty to inquire as to the authority or propriety of any instructions given to Transamerica by the User, and shall be entitled to act upon any such instructions believed to be genuine; and Transamerica shall not be liable for any loss, cost, expense or other liability arising out of any such instructions.
• To the extent that Transamerica uses the Service to transport data or communications, Transamerica shall take reasonable security measures as outlined in the security information for Transamerica; however, Transamerica disclaims any liability for interception of any such data or communications. Transamerica shall not be responsible for, and makes no warranties regarding, the access, speed, availability or any other aspect of the Service. User acknowledges that the Service's response time may be delayed by market volatility, volume, system capacity or system maintenance and repairs.
• The User's consent to the transmission by electronic means of personal account information and data through the Service shall be effective at all times that User uses the Service. User's use of the Service constitutes authorization of the transmission.
• Transamerica reserves the unilateral right to terminate or modify the Service and these terms and guidelines in whole or in part and at any time without prior notice. Transamerica also reserves the unilateral right to terminate or restrict a User's use of the service if User's use is found to be disruptive and abusive of the service or otherwise not in compliance with these Terms and Guidelines.
